Hi:
After at least 3 - 4 calls, over the last month, I finally spoke to IO at NSC. And she took my LIN numbers(other IOs did not even bothered). And then after 1 minute she replied that..my case is waiting to be assigned to Officer.
I even got my I140 checked but she was patient and told my HR that whole cas e is waitng to be assigned to Officer.
Is this something to be looking forward to or is it a usual reply?
Did anyone get this kind of reply?

My aunt (father�s sister) is separated (not divorced) from her husband for over 17 years now. She and her 24 year old son (who was 7 years old when his parents separated) live with our family for last 17 years. Her application for visitor visa was rejected in year 2003 when I had invited her to attend my graduation ceremony. At that time I had not sent a sponsor letter. I have invited her to visit me again and this time I am sponsoring for her visit. She owns a house in India and her son owns a business.
Would her marital status (separated but not divorced) create any issues during the interview?

as per my knowledge"One should file a new LCA for an H1B petition" if work location changed from one state of US to other state.
Can you please tell me the process and how long will it take for this LCA approval?
After LCA approval, do I have to go for Visa stamping though we have valid visa?

On 10/01/09, President Obama signed a continuing resolution to fund continued federal government operations through October 31, 2009. Included in the legislation were provisions to extend the E-Verify, Religious Worker, Conrad 30 and EB-5 programs.
The continuing resolution was attached to the FY10 Legislative Branch Appropriations bill (H.R. 2918), and was passed by the House of Representatives on 9/25/09 and the Senate on 9/30/09.
The E-Verify, Religious Worker, Conrad 30 and EB-5 programs have all been extended for an additional 30 days, though all they may be extended further in the coming weeks once the Senate and House conference the FY10 Homeland Security Appropriations bill (H.R. 2892).

This question is for my wife. She is currently in her 5th year of H1 which expires in Oct-2011. i.e Her 5th year ends on Oct-2010. She is planning to quit her job now (Aug-2010) due to personal reasons and plans to switch to H4. Her employer (Company-A) has already filed for her GC and her LCA and I-140 is approved, but I believe they will be discontinued once she quits. So here are my questions -
1. Since she will have a little bit over 1 year remaining on her H1, can she file for H1 again if she get a new job offer?
2. Assuming that her next company (Company B), files for a GC within one year, Will there be a problem getting her H1B extended ? Since her new LCA (with Company-B) will be filed less than 365 days before her H1b expires.
3. OR Will USCIS look for the LCA filed by Company-A and grant her H1B extension?

I believe finger print needs to be obtained somehow to varify the person. Hope it is not damaged too much. Why dont you try to obtain a doctor's letter stating that she had some blisters and is recovering? Usually for ladies it shouldn't be much of an issue but just as a precaution. The POE officers are usually good towards Indian ladies, particularly when they travel alone. So dont worry too much.

If the new bill gets approved when will it likely take affect? I just had my LC approved today and they are going to file I-140. Before the EB-3 retrogression for all nationalities i was told i-140 an i-485 could be filed at the same time. what impact does the new bill have on my situation?

I've looked in the forums but haven't been able to find an answer for my question. Here's my situation:
EB3 I-140 pending under "Software Engineer" position. 485 has already been applied.
I would like to start a EB2 PERM for a "Senior Software Engineer" position.
Would this constitute a conflict of interest and jeopardize my EB3 140 resulting in a denial?
PS: The intent is to interfile when applying for EB2 140.

hey everyone I was trying to download the swift 3d because a pparently it sweems like a cool one but the download trial wasn't accuriable anyway I looged into the net store and checked the full program, it costs about 159$ so I guess I want to download the trial first to give it a try before spending that much amount of money so if any of you know where to donwlaod it just plz post me a message with the title"FOund what you wanted" on your subjectt space.=)

I applied for fresh EAD I-765 in Jan 2011....it is still in initial review stage.
M on L2 visa (dependant of L1)......and bcoz of some urgent reason ,here onwards i cant stay in US any more.
So,
1. Is there any provision for taking back application of I-765?(means i spent $380 for I-765,so can i get it return?)
Plz ....i need suggestion as early as possible!!
